This Privacy Policy and Privacy Notice (“Privacy Policy”) describes how we collect, use and handle your information and personally identifiable data when you access and use our Website, and applies to any information about you that we collect through the Software and the Service.

This Privacy Policy applies to the downloadable mobile app known as Route One app (“Software”) and the web-based platform that allows tracking of each unit (e.g., unit) using the Software (“Service”). The Software and Service are licensed to freight carriers for use by and with their drivers (collectively “you”). The Software tracks the real-time location of your units.

  1. Information We Collect.
  2. This Privacy Policy covers the collection of personal as well as anonymous information. “Personal Information” refers to information that relates to an identified, or identifiable, person or household. This includes, for example, your first and last name, home address or email address. We may also collect and process sensitive Personal Information, such as payment card number, driver's license identification, or precise geolocation, as further described in this Privacy Policy. “Anonymous information” is data about usage patterns, reported in aggregate that cannot be connected to the identity of a specific individual.USING THE SOFTWARE, YOU CONSENT TO THE COLLECTION OF LOCATION AND LOAD STATUS DATA OF YOUR UNIT. We will collect and store this information for 6 months, then permanently delete it from our servers.

  3. Background Location.
  4. Some of the features of the Platform enable Route One to tailor your experience based on your location (“Location-based Services”) including, but not limited to, offers, event updates, advertisements, and other announcements available to you based on your location. In order to use certain Location-based Services, you must allow Route One access to your localized position (“Location Data”) through your device, which Route One may accomplish through a variety of means, including GPS location, GeoIP, or other available mechanisms. Without limiting the foregoing, even if you have not expressly granted Route One access to your Location Data, Route One may nonetheless have access to location information contained in media content metadata, to the extent you have enabled the application originating such media content to capture and store Location Data. If you choose to disable Location-based Services on your device or to the Software, you will not be able to utilize certain features of the Platform. By authorizing Route One to access your Location Data or media files containing location based metadata, you agree and acknowledge that (i) Location Data we collect from you is directly relevant to your use of the Platform; (ii) Route One may, for so long as you allow Route One to access such Location Data or metadata, provide Location-based Services related to your then-current location; and (iii) Route One may collect, use, store, and/or aggregate your Location Data. PLEASE NOTE THAT LOCATION DATA MAY NOT BE ACCURATE, WHETHER COLLECTED ORIGINALLY BY THE SOFTWARE OR A THIRD PARTY APPLICATION ORIGINATING A PIECE OF MEDIA CONTENT, AND Route One DISCLAIMS ANY AND ALL WARRANTIES RELATED TO LOCATION DATA AND LOCATION-BASED SERVICES. Route One may use third party services as part of its Location-based-Services, including but not limited to Google maps. By using Software or Service you agree to be bound to the terms of such Location-based-Services.

  5. Location-Based Data.
  6. When you use the Software, we collect certain technical and routing information about your mobile device like the browser type, operating system, CPU speed, and Internet Protocol (“IP”) address of your originating Internet service provider. The App is primarily designed, however, to track driver location and load status as well as to allow transportation customers to see a status of their specific delivery. We use the IP address to track your use of the Service, including pages and application screens visited and time spent on each. All of the information that is automatically submitted to us by your browser is considered anonymous information. To the extent that we share such information with third parties, it is not traced back to any specific user and will not be used to contact you.

  7. Cookies.
  8. This Service uses cookies that are small data files that assign you a unique identifier. Cookies allow your mobile device to “talk” with the Service and permit us to administer our Service more efficiently and to provide you with a more personalized and user-friendly service. You can set your browser to notify you when you receive a cookie or prevent cookies from being sent but that may limit the functionality we can provide you when you visit the Service.

  9. How We Use the Collected Information.
  10. We collect personal information only for the purpose of displaying information about your specific unit to the fleet owner and transportation customers. When you submit personal information to us, you understand that you agree to allow us to access, store and use that information for these purposes. We do not share any of your personal information with anyone else but we may share anonymous information with our advertising partners.

  11. Disclosing or Using Personal Information.

In addition to the specific situations discussed elsewhere in this Privacy Policy, we disclose Personal Information in the following circumstances: (a) We may disclose your information to companies that are under common ownership or control with Company, our subsidiaries and/or affiliated companies. (b) We may share your Personal Information only with non-affiliate third parties that perform services on your or our behalf, and only as necessary for them to perform those services. For example, non-affiliate third parties may perform related services, including without limitation, maintenance services, database management, fulfillment, web analytics, and improvement of the features or functionality. We require those non-affiliate third parties to protect any Personal Information they may receive in a manner consistent with our policies. (c) As customer lists and information are considered assets of our business, if we merge with another entity or sell our assets to another entity, our customer lists and information, including personal information you have provided us, would be included among the assets that would be transferred.

  13. Legal Purposes of Disclosure.

We may disclose your information: (a) to conform with the law, research and fulfill our regulatory obligations, respond to regulatory inquiry, respond to claims, or comply with legal process served on Company (e.g., a lawful subpoena, warrant or court order, or discovery request). (b) to enforce or apply our policies or agreements (including to bill and collect for amounts owed to us). (c) to protect and defend our operations and ours and our employees', patrons', users', or the publics' rights, privacy, safety or property (including through surveillance). (d) to protect our Websites, including fraudulent, abusive or unlawful use of our Websites. (e) if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay. (f) to governmental authorities, in our sole discretion, in exceptional circumstances, such as a national emergency, security matter, or other situations in which we deem such disclosure prudent.

To help maintain data accuracy, prevent unauthorized access to or disclosure of, and ensure the appropriate use of your Personal Information, we have put in place administrative, technical, and physical safeguards. In the event that we are required by law to inform you of any unauthorized access to your Personal Information, we may notify you electronically, in writing, or by telephone, if permitted to do so by law. We strive to maintain secure data networks protected by industry standard firewall and password protection. Our security and privacy policies are periodically reviewed and enhanced as necessary and only authorized individuals have access to the personal information that is provided by our users. We do not, however, guarantee that unauthorized, inadvertent disclosure will never occur.

We rely on you to update and correct your Personal Information. Note that we may keep historical information in our backup files as permitted by law. If Platform does not permit you to update or correct certain information, contact us with such request. Deletion of Your Personal Information. You may request that we delete your Personal Information by contacting us with such request and we will delete such Personal Information to the extent required by law. Valid requests to delete may be fulfilled by deleting or de-identifying this information, although we will retain any information we are required to keep by law. Right to Know/Access to Your Personal Information. If required by law, upon request, we will grant you reasonable access to the Personal Information that we have about you. You may request access to, or a portable copy of, your Personal Information by contacting us with such request. Please note that if you make a request, we will need to verify or authenticate your identity (that you are the person that is the subject of the request, the legal guardian of that person, or an authorized representative) to carry out the requests. In order to verify your identity, we may ask for certain additional information that we will only use for the purpose of this verification. If we can't authenticate your identity, we will let you know. Note, in order to maximize the potential that we can identify you when you make a request, please use the information you provided to us, for example when you registered with one of our Websites or otherwise communicated with us. Opt-out. In full compliance with the Delaware Personal Data Privacy Act, the Platform collects personal data without the need for consent from data subjects. You have the right to opt out of data collection and use, including sale, targeted advertising, or profiling for the purpose of facilitating solely automated decisions that produce legal or similarly significant effects on the consumer.   21. Anonymous & Aggregate Information
  22. We collect some information on an anonymous basis. We also may anonymize the Personal Information we collect about you. We obtain aggregate data by combining anonymous data that meet certain criteria into groups. When we employ non-affiliate third parties to anonymize or aggregate data on our behalf, as stated above, we require those non-affiliate third parties to protect any Personal Information they may receive in a manner consistent with this policy. We may share aggregate or anonymous information in various formats with trusted third parties, and may work with those entities to do research and provide products and services, as permitted by laws and our policies.

  23. Children Under the Age of 16.
  24. We do not knowingly collect information from children under the age of 16. Our Website is not directed at persons under the age of 16 and should not be used by them. In no event should children under the age of 16 provide any Personal Information through our website.
